The Occupation Forces Demolish Residences in Ar-Rashayda community west An-Nuwe’ima / Jericho governorate

Violation: Demolishing and confiscating houses and facilities.

Location: Ar-Rashayda Bedouin community – An-Nuwe’ima / Jericho governorate.

Date: March 17th 2021.

Perpetrators: The Israeli Occupation forces and civil administration.

Victims: 11 families from Ar-Rashayda Bedouin community.

Description:

Wednesday morning, March 17th 2021, the Israeli Occupation forces and the so called civil administration demolished and confiscated tents, shacks, water reservoir belong to 11 families from Ar-Rashayda Bedouin community north An-Nue’ima in Jericho, on the pretext of using “governmental properties”.

Noteworthy, the occupation authorities ordered to confiscate the facilities, and take them through a truck to the nearest military camp.

One of the affected Sanad Ar-Rashayda told LRC: “For a while now, colonists and troops have been carrying out frequent attacks and raids, they harass citizens and impose movement restrictions. After a colonists’ raid and harassment in wednesday , the occupation forces stormed the area and without any preceding notices , they confiscated all our properties, and threatened to hurt us in case we did not evict the area.”

The affected Bedouin families practice seasonal migration , during the winter they move to Aj-Jiftlik , while in summer they go back to An-Nuwe’ima , and cattle breeding is their only source of income.

Affected citizen asserted:For many years, we’ve been practicing cattle breeding for living, and three years ago , along with other Bedouin families  we decided to find a location for summer migration . We found a plot north An-Nuwe’ima and it seemed perfect. But unfortunately, “Mevo’ut Yeriho” is built only 300 m away from the targeted plot (west) , while “Umayir” colony is built at the north.”

An-Nuwe’ima area is a targeted spot for Israeli colonization activities, as part of their project to empty the Jordan valley area from its indigenous people and take over it for colonialist projects.

Legal Feedback:

International Conventions and agreements that condemn house and residences demolition:

Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)

Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.

Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.

Article 32 of Hague convention 1907 part g: To destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.

Article 17 of Universal declaration of human rights 10 –Dec- 1948:  No one shall be arbitrarily deprived of his property.
